The "Mainland and Hong Kong Closer Economic Partnership Arrangement" Agreement on Trade in Services signed by the Mainland and Hong Kong on November 21, 2019 (hereinafter referred to as the "CEPA Agreement on Trade in Services" Amendment Agreement) and its annexes, involving certification A total of 7 liberalization measures were approved. Among them, the fourth item covers the "CEPA Guangdong Agreement" and the existing liberalization measures, the fifth item covers the "CEPA Service Trade Agreement" and the existing liberalization measures, and the sixth and seventh items cover the "CEPA Supplementary Agreement Ten" and the existing liberalization measures. The implementation rules for the above measures remain unchanged in the past. Items 1, 2, and 3 are amendments and new liberalization measures. The implementation guidelines are as follows:

1. In the field of compulsory product certification (CCC), Hong Kong testing agencies that are recognized by the Hong Kong Special Administrative Region Government’s accreditation agency and have the capability to test products related to the mandatory product certification system in the Mainland are allowed to cooperate with designated agencies in the Mainland to undertake all products in the CCC catalog Detection work. Specific cooperation arrangements shall be implemented in accordance with the relevant provisions of the "Regulations on Certification and Accreditation of the People's Republic of China".

(1) Scope of implementation

1. Product range

All products in the CCC catalog.

2. Product origin

Products processed or produced in any region.

(2) Qualification and regulatory requirements of testing institutions

If a testing organization in Hong Kong is engaged in the CCC product testing business, it should be recognized by the Hong Kong Special Administrative Region Government’s accreditation agency (Hong Kong Accreditation Office) (hereinafter referred to as the Hong Kong Accreditation Office) and possess CCC product testing capabilities.

The Hong Kong Accreditation Service shall refer to Article 11 of the "Management Measures for Compulsory Product Certification Bodies, Inspection Bodies and Laboratories" (formerly AQSIQ Order No. 65), relevant CCC product certification implementation rules and China National Accreditation Service for Conformity Assessment (CNAS ) Application instructions of laboratory accreditation criteria in related fields, confirm whether Hong Kong testing institutions have relevant CCC product testing capabilities, and issue confirmation documents to qualified testing institutions. The Hong Kong Accreditation Office conducts a supervisory review once a year for testing institutions that have been confirmed to be qualified to confirm that their testing capabilities continue to meet the conditions.

The Hong Kong Accreditation Service will promptly report to the CNCA in a timely manner that the Hong Kong Accreditation Service finds that its testing capabilities cannot continue to meet the requirements.

(3) Implementation procedures

1. Hong Kong testing institutions that have relevant qualifications and intend to undertake the CCC product testing business can contact the mainland CCC product designated certification body for relevant testing business and propose cooperation intentions. The contact information of the designated certification body for CCC products in the Mainland and the scope of its business qualifications can be found on the CNCA website (www.cnca.gov.cn).

2. In accordance with the requirements of the certification implementation rules, the testing agency has reached a cooperation intention with the mainland CCC product designated certification agency to undertake the certification and testing business within the agreed scope by establishing an entrusted relationship. The designated certification body for CCC products in the Mainland will submit the signed cooperation agreement to the CNCA for record. The CNCA publishes on its official website the list of Hong Kong testing agencies that have signed cooperation agreements with the mainland CCC product certification agencies, and informs the relevant mainland market supervision and management authorities.

3. Regarding the Hong Kong Accreditation Service notified to the CNCA that the testing capabilities of Hong Kong testing institutions cannot continue to meet the requirements, the CNCA will inform the relevant mainland CCC product designated certification body, and the Mainland CCC product designated certification body will adjust the cooperation with the testing agency And report the adjustment result to CNCA. The CNCA publishes the list of adjustments on its official website and informs the relevant mainland market supervision and management authorities.

4. If the mainland market supervision and administration department discovers that the Hong Kong testing agency violates the relevant certification and accreditation laws, regulations and implementation rules in undertaking the CCC certification and testing business, it shall report the relevant information to the CNCA, and the CNCA shall notify the Hong Kong Special Administrative Region Government of the relevant information department. The competent department of the Hong Kong Special Administrative Region Government will report the situation to the CNCA after investigation and processing, and the CNCA will decide whether to adjust the directory of institutions.

2. In the field of compulsory product certification (CCC), Hong Kong certification bodies with relevant compulsory product certification capabilities recognized by the accreditation body of the Hong Kong Special Administrative Region Government and the Mainland compulsory product certification bodies are allowed to conduct entrusted cooperation on CCC factory inspections and appoint inspectors Conduct CCC factory inspections on CCC product manufacturers throughout the Mainland.

The factory inspector shall meet the relevant requirements of the "Management Measures for Compulsory Product Certification Inspectors" (CNCA Announcement No. 29, 2004) and obtain the registration qualification of the national CCC product certification inspector.

(3) Implementation procedures

1. The Hong Kong certification body and the mainland CCC product designated certification body contact and propose cooperation intentions on related factory inspection business. The contact information of the designated certification body for CCC products in the Mainland and the scope of its business qualifications can be found on the CNCA website (www.cnca.gov.cn).

2. Applicants submit application materials, participate in inspector training and participate in qualification examinations in accordance with the "Management Measures for Compulsory Product Certification Inspectors" and CCAA's relevant requirements. After meeting the conditions, they can obtain CCC product certification inspector registration qualifications and engage in CCC product factory inspection business . The list of inspectors is published through the CCAA website announcement, and the status of the inspector qualification registration can be inquired through the certification personnel registration and management system on the CCAA website.

4. If the mainland market supervision and administration department discovers that the Hong Kong CCC factory inspector violates the relevant certification and accreditation laws, regulations and implementation rules in undertaking the CCC product factory inspection business, the relevant situation should be reported to the CNCA, and the CNCA instructs the CCAA to investigate and deal with it Decide whether to adjust the status of inspector qualification registration and the published list of Hong Kong certification bodies that have signed a cooperation agreement with the CCC product designated certification body (including the scope of the factory inspection business that can be implemented), and notify the relevant authorities of the Hong Kong Special Administrative Region Government.

3. In the field of compulsory product certification (CCC), Hong Kong certification bodies with relevant compulsory product certification capabilities recognized by the accreditation body of the Hong Kong SAR government are allowed to carry out entrusted cooperation with compulsory product certification bodies in the Mainland, and undertake the whole territory of the Mainland after obtaining the certificate Select test samples at the factory.

(3) Implementation procedures

1. The contracting requirements and procedures are the same as the second (three).

2. The testing of selected samples shall be implemented in accordance with the corresponding certification implementation rules and the specific factory inspection (including sampling) power of attorney.

4. The mainland market supervision and management department is responsible for the supervision and management of activities carried out in accordance with these guidelines

The mainland market supervision and administration department supervises and administers the activities carried out by relevant certification and testing agencies in the mainland in accordance with the revised agreement of the CEPA Service Trade Agreement and this guide.
